Job description:
Project description:
Pharmaceuticals have a special importance in contemporary public policy. At the crossroads of public health imperatives, economic demands, health sovereignty concerns, and globalization dynamics, they constitute a legal subject whose regulation now extends well beyond national borders. Every stage of their lifecycle - from research and manufacturing to potential market withdrawal - is governed by rules sharing a common goal: enforcing the effectiveness of individual right to health through access to safe, available, and quality medicines.
In the era of trade internationalization, the globalization of pharmaceutical supply chains, and increasingly stringent health safety requirements, pharmaceutical regulation can no longer be viewed solely at the level of individual states. Risks associated with the circulation of falsified or substandard medicines, supply difficulties, the emergence of new health threats, and the need for continuous post-market surveillance have fundamentally reshaped the mechanisms of this regulation.
Public health protection now operates within a sphere that transcends national borders, calling for a legal response based on cooperation, coordination, and regional integration. It is against this backdrop that a genuine body of Community law on medicines has gradually emerged; its ambition is no longer merely to harmonize national legislation, but to build a common legal framework that guarantees a high level of health protection.
This trend toward integration is currently evident in several African regions. Faced with shared challenges—particularly regarding access to medicines, as well as their quality and safety—African states have progressively developed mechanisms for cooperation and the alignment of their pharmaceutical policies. This development is part of broader initiatives led at the continental level by the African Union, aimed at strengthening pharmaceutical regulatory systems and fostering better coordination between national and regional authorities. However, significant disparities persist among states regarding institutional capacity as well as human, technical, and financial resources.
The choice of medicinal products as the subject of study aligns with this scientific objective. Among all health products, medicinal products are subject to the most advanced and strictly regulated legal framework. They encapsulate the key challenges facing any legal integration process: the harmonization of standards, the interplay between Community and national legal orders, cooperation among regulatory authorities, the monitoring of rule enforcement, and the guarantee of effective public health protection. As such, they offer a particularly relevant case study for examining the conditions required for the effectiveness of Community law and the mechanisms capable of strengthening its implementation in the long term.
This research is conducted within this framework. By examining the legal, institutional, and practical conditions surrounding the implementation of the free movement of medicines, as well as the key factors that may explain its limitations, it aims to assess its contribution to the realization of the individual right to health, as recognized by universal and regional international conventions.
